Federal Nondiscrimination Laws and Guidance<\/u><\/strong><\/p>\n EMNRD carries out the federally mandated responsibilities to enforce several civil rights laws which, together, prohibit discrimination on the basis of race, ethnicity, color, or national origin (including on the basis of limited English proficiency), sex, disability, and age by applicants for and recipients of federal financial assistance from EPA. (Title VI of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, Section 504 of the Rehabilitation Act of 1973, and the Age Discrimination Act of 1975, respectively). EMNRD is also responsible for enforcing Section 13 of the Federal Water Pollution Control Act Amendments of 1972, which prohibits discrimination based on sex under programs or activities receiving financial assistance in the Clean Water Act.<\/p>\n The regulations of\u202fTitle 40, Code of Federal Regulations (40 CFR), Part 5\u202f\u202f<\/a>and 40 CFR Part 7, which implement the above-mentioned laws, apply not only to intentional discrimination but also to policies and practices that have a discriminatory effect.<\/p>\n Title VI of the Civil Rights Act of 1964 -\u202fAs a recipient of federal funding, EMNRD must follow\u202fTitle VI of the Civil Rights Act of 1964\u202f<\/a>, which prohibits discrimination on the basis of race, color, or national origin in all federally assisted programs. Title VI states: \u201cNo person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.\u201d 42 USC s. 2000d.<\/p>\n Section 504 of the Rehabilitation Act of 1973 <\/strong>-\u202fAs a recipient of federal funding, EMNR must follow\u202fSection 504 of the Rehabilitation Act of 1973\u202f<\/a>, which prohibits discrimination against qualified individuals on the basis of their disability. Section 504 states: \u201cNo otherwise qualified individual with a disability in the United States, as defined in section 705(20) of this title, shall, solely by reason of his or her disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance or under any program or activity conducted by any Executive agency or by the United States Postal Service.\u201d 29 USC s. 794.<\/p>\n The Age Discrimination Act of 1975 –<\/strong>\u202fAs a recipient of federal funding, EMNRD must follow\u202fThe Age Discrimination Act of 1975<\/strong>\u202f\u202f<\/strong><\/a>, which prohibits discrimination on the basis of age in programs and activities receiving federal financial assistance. The statute states: \u201cPursuant to regulations prescribed under section 6103 of this title, and except as provided by section 6103(b) of this title and section 6103(c) of this title, no person in the United States shall, on the basis of age, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under, any program or activity receiving Federal financial assistance.\u201d 42 USC s. 6102.<\/p>\n Section 13 of the Federal Water Pollution Control Act of 1972 –<\/strong>\u202fAs a recipient of federal funding under\u202f\u202fSection 13 of the Federal Water Pollution Control Act of 1972<\/strong>\u202f\u202f<\/strong><\/a>, TCEQ must comply with 40 CFR s. 7.30, which states: \u201cNo person in the United States shall on the ground of sex be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal assistance under this Act . . .\u201d<\/p>\n Title IX of the Education Amendments of 1972 –<\/strong>\u202fAs a recipient of federal funding, EMNRD must follow Title IX pf the Education Amendments of 1972, which prohibits discrimination on the basis of sex in any federally funded education program or activity. Title IX states: \u201cNo person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance . . .\u201d 20 USC s. 1681.<\/p>\n EMNRD <\/u><\/strong>Nondiscrimination Notice<\/u><\/strong><\/p>\n The provisions of Title VI of the Civil Rights Act of 1964, ensures that no person shall be excluded from participation in, be denied the benefits of, or be otherwise subject to discrimination under any program or activity receiving financial assistance from the EMNRD on the basis of race, color or national origin. In addition, EMNRD does not discriminate against any person based on age, sex, marital status, religion, gender identity or gender expression, income, disability, sexual orientation, citizenship status, status as a veteran or any other legally prohibited basis.<\/p>\n EMNRD ensures inclusive public participation by welcoming feedback on agency services and analyzing collected demographic information to ensure accessible services for all.\u00a0 Data collected and maintained from the U.S. Census Bureau includes but is not limited to underserved and unserved populations; population and people; education and language; income and employment; race and ethnicity; business and economy; housing and family living arrangements; residential mobility and veteran status; and a variety of factors important to ensure EMNRD provides services for all New Mexicans and visitors of the State.<\/p>\n EMNRD is committed to the prompt and fair resolution of complaints.\u00a0 Any person who believes they have been aggrieved by an unlawful discriminatory practice regarding EMNRD\u2019s programs has a right to file a formal complaint.
