_module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h2>Boating Regulations and Law Enforcement<\/h2>\n<p>New Mexico State Parks rangers, New Mexico sheriffs, and New Mexico State Police officers have full authority to enforce New Mexico\u2019s boating laws and regulations. Some waters have additional equipment and operational restrictions. Before boating on a particular water, check with the local authorities for additional regulations.<\/p>\n<h3>Know the Law<\/h3>\n<p>To ensure safety on the water for you and others, it is important that boaters be familiar with the <a href=\"https:\/\/nmonesource.com\/nmos\/nmsa\/en\/item\/4422\/index.do#!b\/a12\" target=\"_blank\" rel=\"noopener\">Boat Act<\/a>, the <a href=\"https:\/\/nmonesource.com\/nmos\/nmsa\/en\/item\/4422\/index.do#!b\/a13\" target=\"_blank\" rel=\"noopener\">Boating While Intoxicated Act<\/a>, and regulations for <a href=\"https:\/\/www.srca.nm.gov\/parts\/title18\/18.017.0002.html\" target=\"_blank\" rel=\"noopener\">boating operation and safety<\/a>. Take the time to learn the laws and regulations for vessel length, capacity, <a href=\"https:\/\/www.emnrd.nm.gov\/spd\/activities\/boating-2\/required-safety-equipment\/\" target=\"_blank\" rel=\"noopener\">required safety equipment<\/a>, anchoring and mooring, prohibited operation, and traffic control.<\/p>\n<h3>Alcohol and Drugs<\/h3>\n<p>New Mexico law prohibits anyone from operating under the influence of alcohol or any drug or other controlled substance. It is illegal to operate with a blood alcohol content (BAC) of 0.08 or higher.<\/p>\n<h3>Navigating on New Mexico Waters<\/h3>\n<p>Safe navigation is the responsibility of all boaters. When a person operating a vessel meets, overtakes, or crosses another vessel\u2019s course, the operator shall take the appropriate action.<\/p>\n<ul>\n<li><strong>Meeting head-on:<\/strong> both vessels shall turn to starboard (right).<\/li>\n<li><strong>Overtaking: <\/strong>the vessel that is overtaking another vessel should keep clear of the vessel being overtaken.<\/li>\n<li><strong>Crossing paths:<\/strong> the vessel approaching from the left shall give way by altering course, slowing down, stopping, or reversing.<\/li>\n<li><strong>Power operated vessels:<\/strong> a power operated vessel shall give way to a non-powered vessel.<\/li>\n<li><strong>Vessel departure\/arrival:<\/strong> a vessel approaching a pier or dock shall give way to a vessel leaving a dock.<\/li>\n<li><strong>Distance:<\/strong> vessels shall keep 150 feet away from swimmers, water skiers, fishermen, diver flags, and others not participating in the same activity.<\/li>\n<\/ul>\n<ul><\/ul>\n<p>[\/et_pb_text][et_pb_text ul_position=&#8221;outside&#8221; ol_position=&#8221;outside&#8221; _builder_version=&#8221;4.18.0&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3>Tubing, Waterskiing and Wakeboarding<\/h3>\n<p>Every person who is towed behind a vessel on a tube, water skis, a wakeboard, or a similar object <strong>must<\/strong> <strong>wear<\/strong> a U.S. Coast Guard-approved personal floatation device approved for the activity. New Mexico law states that the following dangerous practices are illegal:<\/p>\n<ul>\n<li>Towing a person between one hour after sunset and one hour before sunrise.<\/li>\n<li>Towing a person within 150 feet of public docks, mooring lines, launch ramps, boats, anglers, swimmers, or any person not also doing the same activity.<\/li>\n<li>Towing a person so that he or she becomes airborne (except on a parasail).<\/li>\n<li>Towing a person in a manner that would cause the person or object being towed to collide with any object or person.<\/li>\n<\/ul>\n<ol><\/ol>\n<ul><\/ul>\n<p>[\/et_pb_text][et_pb_text ul_position=&#8221;outside&#8221; ol_position=&#8221;outside&#8221; _builder_version=&#8221;4.18.0&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p>In addition to carrying all required safety equipment, a <strong>motorboat<\/strong> operator who tows anyone behind his or her vessel must also have on board:<\/p>\n<ol>\n<li>A skier-down flag that is displayed in all directions when the person is in the water.<\/li>\n<li>One of the following\n<ul>\n<li>a wide-angle rear-view mirror that gives the motorboat operator an unobstructed view of the person or object being towed<\/li>\n<li>an observer in addition to the operator<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<p>[\/et_pb_text][et_pb_text ol_position=&#8221;outside&#8221; _builder_version=&#8221;4.18.0&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p>In addition to carrying all required safety equipment, a <strong>personal watercraft <\/strong>operator who tows anyone behind his or her vessel must also have on board:<\/p>\n<ol>\n<li>A skier-down flag that is displayed in all directions when the person is in the water.<\/li>\n<li>An observer on board in addition to the operator.<\/li>\n<li>Manufacturer-approved seating for the operator, observer, and each person being towed.<\/li>\n<\/ol>\n<p>[\/et_pb_text][et_pb_text ul_position=&#8221;outside&#8221; _builder_version=&#8221;4.18.0&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3>Anchoring and Mooring<\/h3>\n<p>It is illegal to:<\/p>\n<ul>\n<li>Anchor a vessel within 150 feet of a marina, boat ramp or courtesy dock.<\/li>\n<li>Attach a vessel to a buoy (except a mooring buoy).<\/li>\n<li>Attach a vessel to a courtesy dock for longer than 10 minutes.<\/li>\n<li>Allow an anchored or moored vessel to drift or damage property.<\/li>\n<\/ul>\n<ul><\/ul>\n<p>[\/et_pb_text][et_pb_text ul_position=&#8221;outside&#8221; _builder_version=&#8221;4.18.0&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3>Prevent Pollution<\/h3>\n<p>Discharging or depositing liquid or solid waste into state waters is illegal. This includes oil and gray water. Polluters may be held civilly liable for cleanup costs and may be fined thousands of dollars. Visit the New Mexico Environment Department <a href=\"https:\/\/www.env.nm.gov\/surface-water-quality\/\">Surface Water Quality Bureau<\/a> to learn more and to <a href=\"https:\/\/www.env.nm.gov\/report-an-environmental-issue-or-incident\/\">Report a Spill<\/a>.<\/p>\n<h3>Prohibited Operations<\/h3>\n<p>New Mexico law states that the following dangerous operating practices are illegal:<\/p>\n<ul>\n<li>Reckless or negligent operation.<\/li>\n<li>Overloading a vessel.<\/li>\n<li>Bow riding.<\/li>\n<li>Teak surfing (\u201cplatform dragging\u201d).<\/li>\n<li>Sitting on a seat back while the vessel is underway.<\/li>\n<li>Allowing your legs to hang overboard at any time.<\/li>\n<li>Allowing a child younger than 13 to operate a vessel without onboard adult supervision.<\/li>\n<\/ul>\n<p>[\/et_pb_text][et_pb_text ul_position=&#8221;outside&#8221; module_id=&#8221;ECOS2&#8243; _builder_version=&#8221;4.21.0&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3>New Engine Cut-Off Switch Law<\/h3>\n<p><span>Engine Cut-Off Switches (ECOS) were developed to help avoid propeller injuries and to prevent runaway motorboats.<\/span><\/p>\n<p>Beginning April 25, 2023, a <strong>motorboat <\/strong>operator must use the engine cut-off switch link while the motorboat is on plane or above no-wake speed.\u00a0 Exceptions are:<\/p>\n<ul>\n<li>When fishing, docking or trailering.<\/li>\n<li>The engine is three horsepower or less.<\/li>\n<li>An engine cut-off switch was not installed by the manufacturer.<\/li>\n<li>The vessel is 26 feet or longer.<\/li>\n<li>The main helm is in an enclosed cabin.<\/li>\n<\/ul>\n<p>[\/et_pb_text][et_pb_video src=&#8221;https:\/\/www.youtube.com\/watch?v=EHjR9jMpE-c&#8221; image_src=&#8221;https:\/\/www.emnrd.nm.gov\/spd\/wp-content\/uploads\/sites\/7\/ECOS-thumbnail.jpg&#8221; play_icon_color=&#8221;#DA2E25&#8243; font_icon=&#8221;&#xe0a3;||divi||400&#8243; use_icon_font_size=&#8221;on&#8221; icon_font_size_tablet=&#8221;&#8221; icon_font_size_phone=&#8221;&#8221; icon_font_size_last_edited=&#8221;on|desktop&#8221; _builder_version=&#8221;4.21.0&#8243; _module_preset=&#8221;default&#8221; animation_style=&#8221;fade&#8221; locked=&#8221;off&#8221; global_colors_info=&#8221;{}&#8221;][\/et_pb_video][et_pb_text admin_label=&#8221;Text&#8221; _builder_version=&#8221;4.21.0&#8243; _module_preset=&#8221;default&#8221; text_orientation=&#8221;center&#8221; custom_margin=&#8221;||||false|false&#8221; custom_padding=&#8221;|||0px|false|false&#8221; animation_style=&#8221;fade&#8221; locked=&#8221;off&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p><em>Engine cut-off switch devices disengage the motor and prevent runaway vessels and propeller injuries.
