REQUEST FOR PROPOSALS
ISSUED BY THE STATE OF NEW MEXICO, ENERGY, MINERALS AND NATURAL RESOURCES DEPARTMENT,
OFFICE OF GENERAL COUNSEL
FOR LITIGATION SUPPORT SERVICES
The Energy, Minerals and Natural Resources Department (EMNRD), Office of General Counsel is requesting proposals to provide legal services in the matter of Center For Biological Diversity v. New Mexico, D-101-CV-2026-00649.
Legal services shall be provided on a task order basis as requested by EMNRD. Typical services include, but are not limited to; drafting pleadings, drafting motions, defending or taking depositions, expert witness identification/retention, supporting mediation, and potentially conducting trial, among other litigation-related activities as determined by OGC. Tasks shall also include the following:
1. drafting a response to the Plaintiffs’ Complaint filed in the Lawsuit;
2. conducting of discovery, including drafting of written discovery requests, defending, and taking of depositions, and dispositive motion drafting;
3. conferring with the Parties, their management teams and counsel on litigation strategy and tactics, as well as identifying acceptable parameters of settlement, if any;
4. advising the Parties and their management teams on potential risks and benefits of litigation identified during the course and scope of representation;
5. communicating with outside parties/Plaintiffs related to any of the above as necessitated by the requirements of any individual project or as directed by the Parties and their management teams; and
6. providing the Parties and their management teams with brief written progress reports with each invoice.

Offerors shall submit all proposals electronically as a PDF document to the contact above via e-mail or at the above e-mail address no later than 5 p.m. MDT, April 20, 2026. The Offeror is responsible for confirming receipt of the proposal with the Contact Person by the proposal due date. EMNRD shall not accept proposals received after this date and shall make absolutely no exceptions for proposals not received at the above location by the appointed time.
This public notice is given pursuant to NMSA 1978, Section 13-1-113. The Procurement Code, NMSA 1978, Sections 13-1-28 through -199, imposes civil and criminal penalties for its violation. In addition, New Mexico criminal statutes impose felony penalties for bribes, gratuities, and kickbacks.

Annual Financial and Compliance Audit
The State of New Mexico Energy, Minerals and Natural Resources Department (EMNRD), is requesting proposals from Independent Public Accountants (IPAs) to perform the annual financial and compliance audit of EMNRD’s financial statements for the fiscal year ending June 30, 2026, as well as the Youth Conservation Corps (YCC), which is administratively attached to EMNRD.
The audit shall cover EMNRD’s and YCC’s entire operations and shall be comprised of a financial and compliance audit of the statements and schedules at the individual fund level. The scope of the audit includes government-wide financial statements, fund financial statements, budget comparison statements, notes to the financial statements, component unit fund financial statements and related combining statements, and combining financial statements. The successful IPA shall conduct the audit in accordance with the standards specified in 2.2.2.10.

The annual audit report must be received in the Office of the State Auditor no later than November 1, 2026. (2.2.2.9A.1 NMAC). EMNRD, in conjunction with the successful IPA, shall identify a schedule of audit deliverables and agree to milestones for the audit to ensure that EMNRD’s books and records are ready and available for audit and the auditor delivers services on time. The audit deadline shall be based on a schedule of deliverables and milestones; however, the deadline cannot extend beyond November 1, 2026.

Contact Person and Submission of Proposals: An electronic PDF copy of proposal must be received no later than 5:00 PM, Friday, March 20, 2026, to Procurement Manger at matthew.lovato@emnrd.nm.gov. “PROPOSAL FOR FINANCIAL AUDIT” must be stated on subject of email submission. Absolutely no exceptions shall be made for proposals not received by the appointed time.
